1. Agreement to Terms

These Terms of Service ("Terms") form a binding agreement between you and Maffeo & Co LLC, a Louisiana limited liability company ("we," "us," or "Capitol Gain"), governing your use of the Capitol Gain website, dashboard, and related services (the "Service").

By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. What Capitol Gain is

Capitol Gain is an information and analytics platform that aggregates publicly available data on congressional financial disclosures, federal legislation, and related signals. It includes an AI-powered analysis layer called Seylah that produces summaries, pattern matches, and insights from that data.

The Service is provided "as-is" for informational purposes only.

Capitol Gain is not a registered investment advisor, broker-dealer, or financial planner. Nothing in the Service constitutes financial, investment, legal, or tax advice. All content — including Seylah's AI-generated insights, signal scores, and pattern detections — is for informational and educational purposes only.

You are solely responsible for your investment decisions. Past performance does not guarantee future results. Trading securities involves risk, including the possible loss of principal. Consult a licensed financial advisor before making investment decisions.

Capitol Gain does not execute trades, hold customer funds, or provide brokerage services.

We may suspend or terminate accounts that violate these Terms or that show evidence of automated abuse, credential sharing, or fraudulent payment activity.

5. Subscriptions & billing

Pricing tiers

Capitol Gain offers a free tier and paid subscription tiers (currently Pro at $24.99/month and Elite at $49.99/month). Specific features available at each tier are described on our Pricing page.

Payment processing

Paid subscriptions are processed through Stripe, Inc. By providing payment information, you authorize us (via Stripe) to charge the applicable subscription fee on a recurring monthly basis until you cancel.

Cancellation

You may cancel your subscription at any time through your account settings or by contacting us. Cancellation takes effect at the end of your current billing period. You retain access to paid features until that period ends.

Refunds

Subscription fees are generally non-refundable once charged. We may issue refunds at our discretion for service outages, billing errors, or other extraordinary circumstances. Contact us within 7 days of a charge to request a refund consideration.

Price changes

We may modify subscription prices with at least 30 days' notice via email. Continued use after the new price takes effect constitutes acceptance.

While we work to keep data accurate and timely, we cannot guarantee its completeness or accuracy. Data may be delayed, contain errors, or be modified by upstream sources without notice. Verify any data before acting on it.

The Service is provided on a best-effort basis. We do not guarantee uninterrupted access. Scheduled maintenance, third-party outages, and unforeseen technical issues may affect availability.

8. Intellectual property

All content, code, design, branding, and Seylah-generated insights produced by the Service are owned by Maffeo & Co LLC or our licensors and are protected by U.S. and international intellectual property laws.

You may view, save, and use Capitol Gain content for your personal, non-commercial decision-making. You may not republish, redistribute, or commercially exploit any part of the Service without our prior written consent.

The underlying congressional disclosure data is in the public domain; our value-add lies in the aggregation, analysis, and presentation.

9. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, for any breach of these Terms or for any other reason we deem necessary to protect the Service or its users.

You may delete your account at any time by contacting us at [email protected]. Upon deletion, we will remove your personal data per our Privacy Policy.

10. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted use. We expressly disclaim any warranty that the Service will produce profitable trading outcomes.

To the maximum extent permitted by law, Maffeo & Co LLC, its officers, employees, and affiliates shall not be liable for:

12. Changes to these terms

We may update these Terms from time to time. Material changes will be communicated via email to your registered address and/or via in-product notice at least 14 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance.

13. Governing law

These Terms are governed by and construed under the laws of the State of Louisiana, without regard to its conflict of laws principles. Any disputes arising from these Terms or your use of the Service shall be resolved exclusively in the state or federal courts located in Bossier City, Louisiana, and you consent to personal jurisdiction in those courts.
